TERMS AND CONDITIONS - RENTAL AGREEMENT
RATES & FEES
Guests acknowledge, understand, and agree that the moment Guests give their credit card information, Empire Home Investors, LLC is authorized to charge credit card for the rental amount agreed upon including required fees and 12% lodging tax.
Guest shall provide a guest list prior to driving directions being sent. If a guest is found to exceed the maximum occupancy of your cabin, guest will be charged a minimum of $200 and it will be considered a breach of contract and may result in immediate eviction with NO REFUNDS.
GUESTS MAKING RESERVATION MUST BE AT LEAST 25 YEARS OLD and by submitting their reservation they are confirming that they are 25 years old or older and they will be present at the property.
CANCELATIONS & RESCHEDULING
Cancelations, rescheduling, or changes must be submitted in writing and confirmed by Empire Home Investors, LLC no later than five (5) days prior to check-in date, in order to receive refund. If cancelations, rescheduling, or changes are made less than five (5) days prior to check-in date, NO REFUNDS will be given however, EHI will work with them to re-book the cabin and if they are able to do so, a refund may be made. If booking through a site other than Hide’n Go Creek, our terms and conditions will still apply. Empire Home Investors, LLC is not responsible for Guests inability to arrive or if Guests chooses to depart early for any reason, or if members of Guests party do not show up NO REFUNDS OR REBATES will be offered. Massage cancelations less than 48 hours prior to appointment will not be refunded.
REQUIRED FEES:
The required fees which include cleaning, processing and damage waiver, is automatically added to each reservation. The required fees differ depending on the property. The damage waiver will cover unintentional accidents which may have caused damage up to $250.00. Any damages that occur due to guest negligence is not considered unintentional and shall be at the guest’s expense. EHI reserves the right to use it's discretion as to what is considered accidental vs intentional or negligence on the part of the guest. The damage waiver fee does not apply to our cleaning fee, which is explained below. Guests agree to call Empire Home Investors if any damages or defects are noticed.
CLEANING:
Premises are to be left in a clean, undamaged condition, and Guests are asked to follow check-in and check-out procedures located in the cabin book. Properties have been cleaned and inspected prior to Guests arrival. If property is left in a condition that requires additional cleaning not normally having to be done (carpet cleaning, food left in pots and pans, etc.,) an additional cleaning fee may be charged to the guest. Guest would be notified prior to that charge taking place.
REFUNDS
This Cabin Rental Agreement is a legally binding agreement between Guests, & Empire Home Investors, LLC/Hide’n Go Creek Cabin. Your reservation binds you to a specific period of time. EHI will make every reasonable effort to correct any problem that arises during your stay in a timely manner. There should be no expectation of refund, and there will be no refund or relocation because you are disappointed with the property you have chosen to rent or in the event that something associated with the property is not working to your satisfaction. There will be no refunds or compensation for: Acts of God, Mother Nature (ie Snow/Ice), acts of war or government agencies, road maintenance, gas shortages, power outages or water outages.
CHECK IN & CHECK OUT TIMES
Check in time is 4:00 PM; check-out is any time prior to 11:00 AM. Cabin will not be available until check-in time of4:00 PM. Guests acknowledges Agreement/Contract and authorizes Empire Home Investors, LLC to charge their credit card on file an amount up to one night's rental for a check-in earlier than 4:00 PM or a check-out later than 11:00 AM.
DIRECTIONS
Directions will be emailed three (3) days prior to your arrival date providing the reservation has been paid in full and guest list has been submitted. To avoid getting lost, we highly recommend you DO NOT use GPS or internet mapping once you arrive in Ellijay. Please PRINT directions as cell service is not always available. Mileage markers and landmarks are included to ensure your safe arrival. If Guests leave home without directions, Empire Home Investors, LLC/Hide’n Go Creek Cabin cannot be held responsible for Guests being unable to find their rental unit.
Roads leading to some rental properties are dirt, gravel, bumpy and mountainous. Empire Home Investors, LLC/Hide’n Go Creek Cabin is not responsible for conditions of road. NO REFUNDS will be offered.
PET POLICY
(Dogs Only) 2 DOGS 50# or under are allowed for a non-refundable fee of $75.00 per dog.
Guests acknowledge, understand, and agree that for Empire Home Investors, LLC/Hide’n Go Creek Cabin to continue to offer PET FRIENDLY CABINS these policies must be adhered to. Please notify us if your pet is over 50 pounds or for more than 2 pets. Prior approval from office is needed and must be noted on your reservation.
Pets are not permitted in hot tub. Guests agree to pay minimum $100 cleaning fee if pet gets in the hot tub.
Pets must be completely housebroken, well behaved, and pest free.
Pets are not allowed on furniture or on or in human beds. An additional fee will be applied if there is evidence of a pet being on furniture.
Pets shall NOT be left uncrated when left alone in cabin.
Guests agree to pay for any damages caused by pets. If pets have an accident in cabin, all clean-up will be performed by the Guests. Guests further agree to pick up waste from the grounds and bag it and deposit in outside garbage cans. Guests agree that failure to comply with clean-ups of either inside cabin or outside cabin will result in an additional cleaning charge of no less than $150.
Guests agree to be in full control of their pets at all times and take full responsibility for their pets. For your dog’s protection, please keep him/her on a leash at all times and be wary of other dogs. You are surrounded by thousands of acres of forest, pets can get lost very easily if they are off their leash.
If any of these Pet Policy items are not met, Guests are in violation of this Agreement/Contract. Guests acknowledge Agreement/Contract and authorize Empire Home Investors, LLC/Hide’n Go Creek Cabin to charge the credit card on file for any damages sustained.
CONDUCT
Each of our properties are privately owned and not built to accommodate large number of tenants. Only the guests listed on the guest list are permitted at the cabin. Our cabins are not venues for parties, weddings, reunions, etc. where the maximum occupancy exceeds the guest list, EVEN if guests are not spending the night. Contact us if you have any questions regarding this policy.
NON SMOKING - All cabins are no smoking properties. Guests agree to pay not less than $250 for odor abatement if they smoke in the cabin or if cigarette butts are left on the grounds.
No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed in rental properties. Guests agree that if Guests are arrested for underage drinking at rental properties or if Empire Home Investors, LLC/Hide’n Go Creek Cabin observes Guests under the legal age of twenty-one (21) drinking alcoholic beverages, this Agreement/Contract may be terminated and Guests evicted with no refund or rebate. Illegal drug use is strictly prohibited.
Maximum occupancy is stated in all accommodation descriptions. Guest further agrees that each additional guest over the age of 4, including visitors, will be listed and on file with Empire Home Investors, LLC/Hide’n Go Creek Cabin. Roll away beds, inflatable mattresses & sleeping bags are prohibited unless approved in advance of arrival.
Use of premises shall not be such as to disturb or offend neighbors or residents, including but not limited to; parties, excessive speeding through neighborhoods, riding of ATV's or Off Road Motorcycles/Dirt Bikes, excessive noise and/or obnoxious behavior, discharging of Firearms, BB/Pellet Guns, Paint Ball Guns, or Fireworks, etc. Empire Home Investors, LLC/Hide’n Go Creek Cabin reserves the right to terminate this Agreement/Contract and to demand that disruptive Guests vacate the premises, thereby forfeiting all monies to Empire Home Investors, LLC/Hide’n Go Creek Cabin. Noise carries in the mountains, refrain from making excessive noise between the hours of 10 pm - 8 am. NO REFUNDS OR REBATES will be offered. Any violation of the above terms of conduct will result in immediate eviction. NO REFUNDS OR REBATES will be offered.
AMENITIES
CABLE/SATELLITE TV - Empire Home Investors, LLC/Hide’n Go Creek Cabin cannot guarantee TV channel availability. Some Rental properties offer premium packages, i.e., Movie Channels, Sports Channels, Pay Per View, etc. but not all do. Empire Home Investors, LLC/Hide’n Go Creek Cabin nor the guest, cannot under any circumstance activate premium channels. If guests unplug anything from the TV's or their devices and they are not reconfigured correctly, resulting in a reconnection service call, guest will be charged accordingly, not less that $50.00.
FURNISHINGS/FURNITURE - All furnishings/furniture in the cabin are in place as the owners wish them. Guests agree to pay not less than $100 if furniture is rearranged in such a manner that results in cleaning services being delayed.
LONG DISTANCE CALLS - Cabin telephones are toll restricted and do not permit long distance calls except for calling card calls, credit card calls, collect calls, valid third party calls, and emergency (911) calls. Guests agree that any special feature calls including but not limited to; Call Return, Call Block, Call Forward that Guests activates will be billed to Guests credit card on file plus a $15 service charge per incidence. Cell phone coverage varies by carrier and signal strength may be poor or non-existent in some areas.
PROPANE GRILLS - Properties with propane grills are fueled by liquid propane, and under NO circumstances may Guests add charcoal or any derivative of charcoal to the propane grills. Guests agree that if Guests add charcoal to a propane grill, Empire Home Investors, LLC/Hide’n Go Creek Cabin is authorized to charge not less than $100 to Guests credit card for cleaning of grill.
FIREPLACES & FIRE PITS - DO NOT LEAVE BURNING OR SMOLDERING FIRES UNATTENDED
Guests acknowledge, understand, and agree that gas log fireplaces are seasonal and are only operational from October 1st through April 30th. No other items may be burned in gas log fireplace, including but not limited to; sticks, wood, charcoal, lava rocks, etc. Gas logs may not be moved or re-stacked; guest agrees to pay not less than $200. if logs have been moved. All gas starters in wood burning fireplaces have been capped off and no gas is available.
Wood burning fireplaces inside the home adhere to the same seasonal dates as the gas log fireplaces, however, exceptions to this are authorized if unpredictable weather intrudes. During firewood season, Guests are responsible for their own starter logs and matches. NO LIGHTER FLUID ALLOWED. A starter supply of firewood (1 to 2 fires) will be provided during season. Additional wood is available at the guests expense if they call our office and order in advance.
FIRE PITS - Guests acknowledge, understand, and agree that fire pits may be used year round, however, firewood is NOT provided for use in the fire pits. Guests must provide their own wood to burn in fire pits. If a property does not offer a fire pit guests will not make one. Guests agree to pay not less than $100, if any other items are burned in fireplaces.
HOT TUBS - POOLS - Guests may not add any objects or chemicals to the hot tubs or pools. Guests agree to pay not less than $100, if hot tub or pool has been compromised in such a manner that results in cleaning services being delayed. Hot tubs & pools have been cleaned prior to Guests arrival. Guests agree to pay an additional charge of $50 if Guests request an additional cleaning of hot tub during stay. Guests understand that hot tub & pool usage is at their own risk and guests agree they will not hold Empire Home Investors, LLC/Hide’n Go Creek Cabin or Property Owner responsible for any injury or reaction from it's use. It is absolutely forbidden for children to be in the hot tub or pool without a responsible adult. Dogs are not allowed in the pool or the hot tub and if there is evidence that they have been there will be a charge of not less than $200. Pool/Hot Tub Rules are posted at the property and guest agrees to adhere to them.
MAINTENANCE ISSUES
In case of a breakdown of any property equipment, guests shall notify Empire Home Investors, LLC/Hide’n Go Creek Cabin immediately. We will make every reasonable effort to correct any problem that arises during your stay in a timely manner. We cannot guarantee; heat, air conditioning, electricity, water, any appliances, cable, satellite, television, telephones, electronics, gas logs, grills, etc. NO REFUNDS OR REBATES will be given. Should a repair person make a call to repair or replace a unit that is found to be in non-working order and the problem was due to Guests oversight, neglect or misuse, Guests agree that the repair call costs may be billed to the Guests credit card on file.
LOCK OUT - A lock out of Guests from cabin will result in a $25 service call during business hours. Guests agree that a lock out after business hours will result in a locksmith being called and Guests credit card being charged accordingly.
KEY RETURN - Guests are responsible for the return of the property key. They are to be returned to the lock box or as instructed in the cabin. If the property key is not returned upon check-out, Guests agree that Empire Home Investors, LLC/Hide’n Go Creek Cabin is authorized to charge the credit card on file not less than $100 for the costs of re-keying or replacing all of the locks and re-issuing new keys to owners, cleaning crews, and Mountain Oasis Cabin Rentals.
BEAR - DEER - SNAKES -LADYBUGS - INSECTS - Guests are in the mountains and woods and depending upon the time of year may encounter Bear, Deer, Turkey, Ladybugs, Carpenter Bees, Wasps, Scorpions, Snakes, Ticks, Ants, Chiggers, Squirrels etc. Guests are encouraged to dress accordingly and to bring insect repellent for outdoor activities. NO REFUNDS will be give because you have encountered one of these pests in or around the property.
CONSTRUCTION - Guests acknowledge, understand, and agree that construction of new accommodations and attractions occur in resort areas. NO REFUNDS OR REBATES will be offered for inconveniences due to but not limited to; construction, construction noise, road repair, and maintenance. Routine maintenance is sometimes required while a guest is at a property (grass cutting, weed eating, blowing leaves). If this does occur, it will not happen before 9:00 am and every effort will be made not to disturb the guest.
RIGHT OF ENTRY
Guests acknowledge, understand, and agree that Empire Home Investors, LLC/Hide’n Go Creek Cabin reserve the right to enter property at any time to investigate disturbances, check occupancy, check damages, make repairs, alterations, and improvements.
ITEMS LEFT AT CABIN
Empire Home Investors, LLC/Hide’n Go Creek Cabin is not responsible for any items Guests leaves behind in cabin, however, if items are found we will make an effort to contact guest to see if guest would like items shipped to them. A fee of $25 plus UPS shipping costs for the return will be charged to credit card. Items will be discarded or donated after 7 days.
AGENCY DISCLOSURE
Empire Home Investors, LLC/Hide’n Go Creek Cabin serves as the Agent and represents the owners of vacation properties in its rental program, and is acting at all times, in and for the best interest of the owners. Guests are a licensee of the Owner and not a tenant; and Guests are not acquiring any interest in the property.
Empire Home Investors, LLC/Hide’n Go Creek Cabin reserves the right to refuse service to anyone. All rental properties are leased without regard to race, color, religion, sex, national origin, or handicap.

VIOLATION OF TERMS & CONDITIONS
Guests acknowledge, understand, and agree that Empire Home Investors, LLC/Hide’n Go Creek Cabin reserves the right to remove renter, if any of the of Agreement/Contract items are not met. NO REFUND OR REBATE will be offered.
EXPEDITED EVICTION
A material breach of this Agreement by Guests, which, in the sole determination of Empire Home Investors, LLC/Hide’n Go Creek Cabin, results in damage to the Premises, personal injury to Guests or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guests tenancy. Violation of any of the rules contained herein will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit. If the tenancy created here under is for 30 days or less, the expedited eviction procedures set forth in the Cabins Act will apply. Guest(s) may be evicted under such procedures if Guest(s): (I) hold over in possession after Guest(s) tenancy has expired; (II) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; (III) fail to pay rent as required by this Agreement, or (IV) have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in.
DISPUTES
This Agreement/Contract shall be governed by and interpreted in accordance with the laws of the State of Georgia and be treated as though it were executed in the County of Gilmer, State of Georgia. Any action relating to this Agreement/Contract shall be instituted and prosecuted only in the Gilmer County Superior Court, Ellijay, Georgia. Guests specifically consent to such jurisdiction and to extraterritorial service of process.
INDEMNIFICATION & HOLD HARMLESS
Guests acknowledge, understand, and agree that Guests shall be solely responsible for any property damage, accident or injury to any person or loss sustained by any person, including loss of money, jewelry, and other items of personal property, arising out of or in any way related to Guests use of the premises or the items of personal property provided by Empire Home Investors, LLC/Hide’n Go Creek Cabin, the Owner at Guests request. Guests shall inspect and be familiar with proper use and application of such items prior to using them. Guests hereby agree to INDEMNIFY and hold Empire Home Investors, LLC/Hide’n Go Creek Cabin, employees, owners and officers; and/or Homeowners harmless from any and all claims including those of third parties, arising out of or in any way related to Guests use of premises or the items of personal property provided therein. Guests hereby agree to hold Empire Home Investors, LLC/Hide’n Go Creek Cabin and/or homeowner, employees and officers harmless and to indemnify same against any and all claims which may arise during and after the course of rental as a consequence of any acts or omissions of Empire Home Investors, LLC/Hide’n Go Creek Cabin and/or cabin owner, employees and officers. Guests assume the risk of injury or other losses relating to any recreational activities and will hold owner and Empire Home Investors, LLC/Hide’n Go Creek Cabin harmless with respect there to.
INTERNET ACCESS TERMS OF USE
Empire Home Investors, LLC/Hide’n Go Creek Cabin, Inc., and Cabin Owners/Account Holder as part of this rental package for all properties offered for rental by MOCR, offers access to internet service provided through an account with ETC.
The undersigned renter, requesting and accepting the inclusion of this access as part of the rental package, agrees to abide by the provisions of the Acceptable Use Policy and Terms of Service of ETC which may be viewed at http://etcnow.com under "Terms and Conditions" and to the additional terms and conditions set forth below:
1. Changes to the system may be made by service provider ETC during your use. Empire Home Investors, LLC/Hide’n Go Creek Cabin and Property Owners/Account Holder is not responsible for degraded or interrupted services. All information you receive from or through the account is provided "as-is" "as available" and all warranties, express or implied are disclaimed. If you are dissatisfied with the internet access, you may immediately discontinue use, such being your sole remedy, and understand that and agree that access to this service would not be made available to you without these limitations.
2. Access is furnished subject to the condition that it will not be used for unlawful purpose.
3. You certify that you are 25 years of age or older and that minors use of the service during your rental period shall be deemed to be with your express permission. and that as renter, you are solely responsible for the actions of the minor in using this account.
4. You further understand and agree that permission to use passwords or access codes to access codes to access to this internet account/service terminates upon termination of your rental contract.
5. You agree to defend, indemnify, and hold Mountain Oasis Rentals,Inc., and Property Owner/Account Holder harmless from any and all liabilities, costs, and expenses, including reasonable attorney's fees, related to or arising from any violation of this agreement by you or those who access the service and account through you, and the use of service of the internet and the placement or transmission of any message, information, software, or other materials on the internet by you or those who have access to the service through you.
By accepting the terms of this rental agreement, you are agreeing to the terms of the Acceptable Use Policy and foregoing provisions and take full responsibility of addressing the conditions and policies of access and use of the internet to all members of my party.
